Please read these Terms of Service ("Terms") carefully before using the `bruegs.com` website and its AI interaction services (the "Service") operated by Nick Brueggeman.

1. Acceptance of Terms

By accessing or using the Service, subscribing, or clicking to accept these Terms when the option is made available, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Service Description & Disclaimers

The Service provides a subscription primarily intended to grant users access to interact with various Artificial Intelligence (AI) models integrated into the `bruegs.com` website. The specific models available may include custom-developed models or third-party models selected by Nick Brueggeman for experimentation.

• Experimental Service: You acknowledge that the AI models and the Service are experimental, provided "AS IS" and "AS AVAILABLE", and are subject to frequent change, interruption, or discontinuation without notice. The purpose of the subscription is primarily to allow access for experimentation and interaction with these developmental models.
• No Guarantees: Nick Brueggeman makes NO GUARANTEES, WARRANTIES, OR REPRESENTATIONS regarding the uptime, availability, reliability, accuracy, completeness, consistency, or functionality of the AI models or the Service. Bugs, errors, inaccuracies, and downtime are expected and likely as part of the developmental nature of the Service. The specific AI models available may change at any time without notice based on development progress, cost, operational factors, or other reasons determined by Nick Brueggeman.
• Use At Your Own Risk: Your use of the Service is solely at your own risk. All warranties, express or implied, in connection with the Service and your use thereof, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement are disclaimed.
• Product Description: The core product offered via subscription is enhanced access (typically related to usage limits compared to any free tier) to the pool of experimental AI models available on the site at any given time. Specific features beyond access levels are not guaranteed.

3. Subscription & Payment

• Billing: Premium subscriptions are billed on a recurring basis (e.g., monthly) as specified during the checkout process. Payments are processed via the third-party payment processor, Stripe. You agree to provide current, complete, and accurate purchase and account information.
• Pricing: Subscription prices are listed during the Stripe Checkout process and are subject to change for future billing cycles upon notice.
• Cancellation: You may cancel your subscription at any time through the "Manage Subscription" link provided within the service (which directs you to the Stripe customer portal) or by contacting me at nicholasbrueggeman@gmail.com. Cancellations will take effect at the end of your current paid billing cycle; access continues until that date unless otherwise terminated.

4. NO REFUND POLICY

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. You explicitly acknowledge and agree that due to the experimental nature of the Service, the potential for downtime, the immediate access granted upon subscription, and the ongoing development, NO REFUNDS OR CREDITS will be issued for any reason. This includes, but is not limited to, partial subscription periods, service unavailability, AI model downtime or removal, changes in AI model features or availability, dissatisfaction with the Service, or your cancellation of the Service. As long as the `bruegs.com` website is hosted and accessible, your payment obligations continue for the term of your subscription, and no refunds will be provided even if specific AI models or functionalities become inaccessible.

5. User Conduct

You agree not to use the Service for any unlawful purpose or in any way that could harm the Service or impair anyone else's use.

6. Modifications

Nick Brueggeman reserves the right, at his sole discretion, to modify or replace these Terms or modify, suspend, or discontinue the Service (or any part thereof) at any time without prior notice. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.

7. Limitation of Liability

In no event shall Nick Brueggeman be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
